Highlite hi-tech Fitness Pty Ltd (ACN 605 460 973) (“Highlite”, “we”, “us”, “our”) provides its website at http://www.highlite.com.au and/or any other domain names owned by Highlite (“Website”) to you (“you, “your”, “User”) subject to this Privacy Policy and Terms and Conditions (“Agreement”).

By your continued use of the Website you are deemed to agree to and accept the terms of this Agreement.

If you do not agree to the terms of this Agreement you should not continue to use this site.

Highlite is committed to protecting your privacy. We comply with the National Privacy Principles and all other relevant Australian legislation.

This Website is for your personal, non-commercial use only. You are strictly prohibited from the following:

  • a)downloading, copying, altering, modifying, distributing, adapting, modifying and/or re-transmitting any or all of the content on the Website without our written consent;;
  • b)using the Website or content therein for any commercial use

We either own or have a valid licence to use all intellectual property included on this Website, including, but not limited to registered and unregistered trade marks, graphics, logos, text, images, audio, video clips, software, data compilations, button icons and digital downloads.

YOU INDEMNIFY AND AGREE TO KEEP HARMLESS HIGHLITE AND ITS DIRECTORS, EMPLOYEES, AGENTS AND CONTRACTORS IN RESPECT OF ANY CLAIM, PROCEEDINGS AND EXPENSES (INCLUDING, BUT NOT LIMITED TO LEGAL EXPENSES) ARISING OUT OF ANY BREACH BY YOU OF THIS AGREEMENT OR ANY NEGLIGENT ACT OR OMMISSION IN PERFORMING YOUR OBLIGATIONS UNDER THIS AGREEMENT OR THE INFRINGEMENT BY YOU OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHTS OF ANY PERSON OR ENTITY.

7. GENERAL

  • a) This Agreement is governed in accordance with the laws of NSW, Australia and you agree to submit to the non-exclusive jurisdiction of the state of NSW, Australia.
  • b) Any failure of ours to exercise or enforce any right or provision in this Agreement does not constitute a waiver of that right or provisions.
  • c) This Agreement constitutes the entire agreement between the User and Highlite in relation to any use of the Website.
  • d) The terms of this Agreement may not be assigned by you but may be assigned by Highlite without restriction.
  • e) If any part of this Agreement is found to be invalid or of no force or effect under any applicable laws, the Agreement shall be interpreted as though such part had not been inserted and the rest of the Agreement shall retain its full force and effect.
  • f) Highlite reserves its right to amend the terms of this Agreement from time to time. Your continued use of the Website following such amendments constitutes your acceptance of such revised terms.

9. POSTAGE,  DISPATCH AND DELIVERY

Goods will be delivered on business days. No deliveries will be made on weekends or public holidays.

A signature is required upon delivery. If no one is available to sign for the parcel, a notice will be left at your address notifying you of pick-up arrangements.

We recommend either a work address (please include full business name, receivers name and other relevant details) or PO BOX for prompt delivery.

Next Business Day delivery is available to customers located in Australian CBD, metro and major regional areas (excluding Perth metro and Darwin). Please check the postcodes below to see if you live in a qualifying area. If you are located outside a Next Business Day area, choosing Express delivery will still result in a faster delivery than Standard delivery.

For Next Business Day delivery you must place your order by 2pm (Australian Eastern Daylight Savings Time) on any business day. Orders placed on weekends and public holidays will be despatched on the next business day. If your order is placed after 2pm (Australian Eastern Daylight Savings Time) your order will be delivered on an Express delivery service.

We deliver via Australia Post with an authority to leave. We recommend either a work address or PO Box for prompt delivery. If no one is available to sign upon delivery at your nominated delivery address (private or work) the parcel will be left in a secure spot on the premises, or a card will be left notifying you of alternative pick up arrangements at the nearest Post Office. Pending credit card authorisation, verification and availability of stock, delivery will take up to 3-7 business days for delivery within Australia

IMPORTANT INFORMATION

We cannot accept responsibility for delays in delivery due to unforeseen circumstances (e.g. Strikes, floods etc.). All colours of products are reproduced as accurately as possible, however a slight variation may occur in colour and size specifications. Colours may appear slightly different via this website due to computer picture resolution and individual monitor settings. Offers are available until stocks sell out.

10. OUR REFUND & EXCHANGE POLICY

In addition to your Statutory Rights, should you change your mind we will happily exchange or refund providing the following conditions have been met:

1.The items with the original receipt are returned within 21 days of purchase.

2.Items must be in original condition as purchased, with all labels/tickets attached. Garments must not have been worn.

HOW TO GET A REFUND OR MAKE AN EXCHANGE

Purchases made in store

Purchases made in a Highlite hi-tech Fitness retail store (including purchases in an Australian store for delivery to you) can be returned or exchanged in a Highlite hi-tech Fitness retail store. You must present the receipt you received in the store at the time you purchased your items.

Purchases made online

You can return or exchange an item purchased online:

in any Highlite hi-tech Fitness retail store in Australia; or

by posting it to our Online Store Returns/Exchange address: Highlite hi-tech Fitness Pty Ltd, 93 Merewether St, Merewether, NSW, Australia 2291.

In either case, you must present the receipt you received in your parcel & indicate the reason for the return or exchange.

Please note: all returns or exchanges remain the responsibility of the purchaser until received by Highlite hi-tech Fitness.

REFUNDS – ADDITIONAL INFORMATION

Provided the conditions in our refund & exchange policy have been met, refunds will be processed using the original form of payment. Please note that delivery costs will be excluded unless goods are returned in accordance with your statutory rights (eg. they are faulty or not as ordered).

EXCHANGES – ADDITIONAL INFORMATION

Provided the conditions in our refund & exchange policy have been met, you may exchange an item for something else from Highlite hi-tech Fitness. Exchanges are subject to stock availability. For online exchanges, please list alternative item(s) in case we have sold out of your first choice. Standard delivery charges apply on re-delivery for online exchanges, unless goods are exchanged in accordance with your statutory rights (eg. they are faulty or not as ordered).
